Part 1: Publisher & Privacy Policy

1. Application Publisher & Hosting

The HelmSync mobile application (hereinafter "the Application") is an independent project developed in the free time of a motorcyclist, for the community. HelmSync creates no user accounts, collects no marketing profiles, and does not use your data for advertising or profiling purposes.

The server infrastructure necessary for the Application's operation is hosted by OVHcloud (2 rue Kellermann, 59100 Roubaix, France).

2. Philosophy and Legal Basis (GDPR)

The processing of technical data is based on two distinct legal grounds:

• Execution of the service: Necessary to establish the audio intercom and real-time map display at your explicit request when you join a session.
• Legitimate interest: Necessary to ensure application stability, diagnose technical crashes, and maintain service security.

3. Real-Time Data Transit

HelmSync is an instant communication application. Certain technical data passes through temporarily to provide the service, without being stored or kept permanently:

• Audio streams: The voice stream is routed in real time to other riders via secure communication protocols. This stream is neither recorded, transcribed, nor stored.
• GPS Position: Your geographical coordinates are transmitted in real time only to members of your group. No trip history is kept. Processing stops as soon as you leave the session.
• Connection data: Establishing sessions involves the temporary processing of network metadata (IP addresses). This data transits through our high-performance relays ephemerally.

4. Local Storage on Device

To prevent you from having to reconfigure the app, the following data is written locally on your own phone: your chosen nickname, your motorcycle profile, and your audio settings. They are deleted if you clear the cache or uninstall the application.

5. Security and Third-Party Services

Although no system guarantees absolute security, HelmSync applies state-of-the-art standards. Communication streams (voice, position) natively integrate encryption mechanisms and do not circulate in plain text on the network.

The technical tool Google Firebase Crashlytics may be used to collect strictly technical metadata in the event of an unexpected application closure. These debugging-exclusive reports are not used for advertising purposes.

6. Disclaimer of Warranty (As-Is)

HelmSync is provided free of charge "As-Is", without any express or implied warranty of availability, service continuity, or absence of software errors.

As a hobby project, the developer uses their best efforts to fix malfunctions, but is under no obligation of result or maintenance schedule. Architecture and features may be modified or suspended at any time.

7. In-App Purchases and "Supporter" Model

All communication features are accessible for free. To support hosting costs, the application offers optional in-app purchases as support tiers.

These purchases only unlock local cosmetic items and do not condition the use of the intercom. HelmSync does not collect or store any banking data; all transactions are managed by Apple App Store and Google Play Store.

8. Your Rights (GDPR) and Minor Protection

HelmSync is not intended for children under 13. You have a right to access, rectify, and delete your technical data. Since the application has no centralized database, your rights are mainly exercised by modifying your settings or uninstalling the application.
